  • Tickets, class passes and/or deposits are 100% NON refundable.
  • Workshop and retreat tickets are transferable (re-sellable) to another user on agreement from Marnie Lane in writing for a $20.00 AUD administrative fee.
  • All workshop, roving, performing, incursion, school and party bookings require a 50% non-refundable deposit to secure the booking.
  • Cancellation fees apply for all bookings (more details on this below).
  • Special conditions apply when COVID-19 public health and safety measures warrant an event to be cancelled or postponed.
  • Use of this site constitutes your agreement to the terms outlined below.

This website is operated by Marnie Lane. Throughout the site, the terms “we”, “us” and “our” refer to Marnie Lane (ML). ML offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

General Conditions

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Bookings

Staff / Movement Class & Retreat Bookings

Payment is required in full, in advance to secure your place.

Class passes are valid at all ML classes within the term they were purchased only.

Class passes are non-refundable and non-transferable.

In exceptional circumstances, transfers between terms or between people will be considered on a case by case basis.

Retreat bookings are non-refundable. Retreat bookings are transferable between people for a $20 administration fee.

Staff / Yoga Workshop Bookings

Bookings for all Staff / Yoga workshops, including (but not exclusive to) Holiday Programs, Retreats, Events & Festivals, Corporate Events and Team Building; must be made in writing.

Bookings will be confirmed in writing, will require a 50% non-refundable deposit to be paid, will be invoiced prior to the delivery of the session with the due date for the balance 2 weeks after the session has been delivered. Cancellation fees are outlined in the Cancellation section below.

Party Bookings

Bookings for all parties including (but not exclusive to) Kids Parties, Hen’s Parties, Birthday Parties; must be made in writing.

Bookings will be confirmed when a 50% non-refundable deposit is received.

The balance of the payment is due, upon invoicing, within 2 weeks following the delivery of the session.

Performance Bookings

Bookings for all roving and stage performances must be made in writing.

Bookings will be confirmed in writing, will require a 50% non-refundable deposit to be paid, will be invoiced prior to the delivery of the performance with the due date 2 weeks after the performance has been delivered. Cancellation fees are outlined in the Cancellation section below.

Private lessons

Payment is required in full, in advance.

The date and location will be arranged on an individual basis and confirmed in writing.

Private lessons are non-refundable and non-transferable.

In exceptional circumstances, transfers between people will be considered on a case by case basis and will incur a $20 administrative fee.

Health & Wellbeing

Fit to participate

All forms of movement, dance, staffing and associated exercise may place stress on the body and carry with them the possible risk of physical injury. ML and their instructors shall not be liable for injuries sustained during ML classes and workshops. It is up to the individual to ensure they are fit to participate in the session and have any pre-existing injuries or health conditions cleared by a medical practitioner before attending the session. ML will not be held liable for any losses or damage to personal property.

Wellbeing

ML participants are encouraged to take care of their well-being. To ensure maximum enjoyment:

Suitable clothing

  • Wear comfortable/no shoes

  • Wear comfortable clothes with no tassels, dangly bits or zippers that could catch, dig in, or otherwise limit your movement or ability to participate e.g. leggings and t-shirt

  • Remove jewellery and keep earrings to studs

Food and drink

  • Bring water to stay hydrated

  • Keep snacks light before class

Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

Cancellation, returns and refunds

Where a deposit has been paid that exceeds the cancellation fee outlined below, the balance will be refunded to the client and the remainder of the invoice voided.

Where a deposit has been paid that is less than the cancellation fee outlined below, the client must pay the balance of the cancellation fee and the remainder of the invoice thereafter will be voided.

COVID-19: 

  • Where a party/private/community group booking must be cancelled due to COVID-19 restrictions, no cancellation fee will be charged and the deposit will be refunded in full.

  • Where a corporate/council booking must be cancelled due to COVID-19 restrictions, no cancellation fee will be charged and the deposit will not be refunded. Corporate and council clients are encouraged to postpone the booking for a future event.

Class passes & retreat bookings are non-refundable and non-transferable.

In exceptional circumstances, transfers between terms or between people will be considered on a case-by-case basis.

Private lessons are non-refundable and non-transferable.

In exceptional circumstances, transfers between people will be considered on a case-by-case basis.

Private lessons can only be postponed 3+ days prior to the booking and the amount paid is non-refundable.

ML Yoga / Staff  Retreat is non-refundable. Transfers between people will only be granted in exceptional circumstances or once the retreat has sold out.

Party deposits are non-refundable and non-transferable.

Where a party is cancelled less than 3 days prior to the booking, an additional $50 cancellation fee will be charged.

Workshops, Performance (roving and stage): Deposits are non-refundable and non-transferable. Where a performance/workshop/playspace is cancelled 15-21 days prior to the booking, a $50 cancellation fee will be charged. Where a performance/workshop/playspace is cancelled 10-14 days prior to a booking, a $150 cancellation fee will be charged. Where a performance/workshop/playspace is cancelled within 0-9 days prior to a booking, the full amount of the booking will be charged.

Performer Cancellations: In the unlikely event the entertainer must cancel due to unforeseen circumstances, you will be notified as soon as possible. We will endeavour to find a replacement. Then, if necessary, reschedule, or provide full refund, whichever is in accordance with your preference.

Products or Services

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Product Returns Policy.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Ordering

Before ordering products please read and understand our Terms of Service.

ML wants to get the highest quality services and products to you as soon as possible. In the unlikely event we cannot meet our usual dispatch time we will advise you. If this does occur, you will be given the opportunity to 1) order an alternative, 2) have the product sent as soon as it becomes available or 3) to cancel the order.

All prices quoted are in AUD.

We reserve the right to refuse any order you place with us. We may, at our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

Accuracy of billing and account information

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Debt Collection Policy

If an invoice is not paid on time, ML will:

  1. Contact you with a friendly reminder via email and/or phone

  2. Send you an overdue payment reminder

  3. Send a final notice

  4. Send a formal letter of demand

  5. Engage a debt collection agency to collect outstanding monies including a late fee to cover the cost incurred in debt collection.

Modifications to service and prices

Prices for our products and services are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Product Returns Policy

Be gentle

Take care of your yoga props and staves!! 

Yoga Props – particularly your mat is best kept clean, but spraying with antibacterial spray following a session. This helps maintain your mat. If this is done, your mat need only be thoroughly cleaned every 3-6 months with eucalyptus oil and hot water, and left to dry in the dappled shade.

Fire / Practice Staves – 

Maintaining your props are integral to save you unnecessary repetitive costs. 

Grip – whatever your grip preference, maintaining your grip is essential. Hair, jewellery – bangles, bracelets, necklaces, rings, dropping your staff on unforgiving surfaces such as concrete, sharp corners and metal will damage your grip. Sometimes brushing the grip with a small dustpan brush (if your grip is ridgy) will suffice, if your grip is porous, you will need to wash the grip with hair shampoo and warm water and allow it to dry.

Wicks – fire wicks should be covered while practising. A plastic bag can be wrapped, layered and tied to protect your wicks, socks (baby socks for Dragon Staff wicks), wick covers, carpet, leather / material, etc can be used.

Staff – unless your staff is Carbon Fibre, you will also have to be mindful of staves being bent. The thinner the wall of the aluminium (or similar metal), the more likely the staff is to bend. Drops on hard and / or uneven surfaces, park benches, corners / gutters / grates (concrete / metal  corners), stepping on your staff, will all cause it to bend. Be mindful of your surroundings, and stand your staff up against something will ensure the longevity of your equipment. 

The tape will last longer if you hoop on grass or other soft surfaces. Be gentle when you coil down your travel hoop and be mindful not to fold or kink it. Dance hoops are a little less fragile but it is still important not to lean too hard on them or they will not only become an oval, the plastic will eventually snap.

If you believe the Yoga props or the staff  itself is faulty or damaged then please contact us within 30 days of receiving it.

Faulty or damaged?

If your Yoga props or staves are faulty or damaged, please contact yogawithmarnie@gmail.com / contactstaffer@gmail.com within 30 days of receiving it and, so long as it is a product fault not caused by misuse, we will send it to the Yoga prop / Staff Doctor or replace it.

Otherwise, cost of repair for wear and tear will be calculated on a case by case basis.

What are the details?

Your item must be sent back to us within 30 days of you receiving it. We will not accept returns for equipment that has been scuffed or damaged from use.

Postage

The cost of returning the equipment for refund is at the buyer’s expense.

Refund

Once your return has been verified based on the terms of this policy, you will receive notification via email on the status of your refund request and return payment will be arranged.

Disclaimer of warranties; limitation of liability

Marnie Lane holds Public Liability Insurance and all ML activities are covered under the Marnie Lane policy.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall ML, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

Indemnification

You agree to indemnify, defend and hold harmless ML and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgement you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the State Laws in New South Wales and Federal Australian Law.
